1. Definitions
- "Cogwright", "we", "us", "our" — the watch and clock repair workshop operating at 27 Jalan SS 21/37, Damansara Utama, 47400 Petaling Jaya, Selangor, Malaysia, and at cogwrigh.cyou.
- "Service" — any of the three repair and maintenance services offered: Water Resistance Testing and Seal Renewal, Chronograph Module Service, and Full Mechanical Overhaul.
- "Owner" / "you" — the person dropping off a timepiece or submitting an enquiry via the website.
- "Piece" — the watch, clock, or other timepiece entrusted to Cogwright for service.
- "Service Agreement" — the written or verbal confirmation of the service scope, price, and estimated bench time, confirmed before work begins.
2. Acceptance of Terms
By dropping off a piece at our workshop or submitting an enquiry via our website, you confirm that you are aged 18 or above, that you have the legal capacity to enter into a service agreement, and that you are the lawful owner of the timepiece or have been authorised by the lawful owner to act on their behalf.
These terms govern the relationship between you and Cogwright for all services. Using our website to submit an enquiry constitutes acceptance of these terms as they apply to that enquiry and any resulting service.
3. Service Description
Cogwright provides three defined repair and maintenance services for mechanical and quartz timepieces:
- Water Resistance Testing and Seal Renewal — pressure testing and gasket replacement with signed certificate (RM 460)
- Chronograph Module Service — module dismantling, spring renewal, RTZ re-timing with timing traces and 24-month coverage (RM 2,150)
- Full Mechanical Overhaul — complete disassembly, ultrasonic cleaning, new mainspring and barrel, six-position adjustment, with photographic record and condition report (RM 4,180)
Services are performed at our Damansara Utama workshop. We do not offer postal or courier collection as a standard service. We reserve the right to decline any piece that falls outside our current service scope or that we assess as posing an unacceptable risk to our equipment or staff.
4. Service Scope and Changes
The scope of each service is as described in Section 3 and on our website. Before work begins, the agreed scope is confirmed with you. If inspection reveals a condition outside the agreed scope — for example, a damaged component discovered during overhaul — we will contact you to discuss before proceeding. No additional work will be carried out without your express agreement.
We may decline to proceed with a service at any stage if inspection reveals that the piece cannot be safely worked on, that required parts are unavailable, or that the risk of damage during service is unacceptable. In such cases, we will return the piece and charge only for any work already completed.
5. Owner Responsibilities
You agree to:
- Provide accurate information about the piece, including any known history, prior repairs, and observed issues
- Disclose if the piece is subject to any insurance, loan, or ownership dispute
- Collect the piece within 30 days of notification that service is complete. Pieces left beyond 30 days without communication may incur a storage charge of RM 5 per day
- Not misrepresent the value, provenance, or condition of a piece when dropping it off
6. Payment Terms
Prices are stated in Malaysian Ringgit (RM) and are fixed at the amounts listed in Section 3, subject to any variations agreed in writing before work begins. Payment is due in full on collection of the piece. We accept cash, bank transfer, and major debit cards. Credit card acceptance is subject to availability at the time of visit.
If additional work was agreed during the service, the additional charge will be stated on the updated service record before collection. We do not charge assessment or quotation fees.
Refunds: Services that have been completed as agreed are not eligible for refund. If we have not yet commenced work, you may cancel with no charge. If work is partially completed and you choose to withdraw, we will charge for the work performed to that point, calculated proportionally.
7. Service-Specific Terms
Water Resistance Testing: The pressure certificate reflects the tested result on the day of testing. Cogwright does not represent that the tested depth will be maintained indefinitely; gaskets degrade over time and under use. We recommend retesting every 12–24 months.
Chronograph Module Service — 24-Month Coverage: If the same chronograph function develops a fault related to the work we performed within 24 months of collection, we will examine the piece and, if the fault is attributable to our work, address it without additional bench charge. This coverage does not extend to damage caused by impact, water ingress, or modifications made by a third party after collection.
Full Mechanical Overhaul: The condition report issued on completion reflects the state of the piece as found and as left. Wear noted in the report as "retained by owner's instruction" is not covered by any subsequent complaint arising from that specific wear.
8. Intellectual Property
All content on the Cogwright website — text, design, service documentation templates, and imagery — is the property of Cogwright or is used under licence. You may not reproduce, distribute, or commercially exploit any part of it without prior written consent. Service documentation (certificates, condition reports, timing traces) issued to you in connection with your specific service are yours to retain.
9. Disclaimers
Repair and maintenance of timepieces involves inherent risk. While we take every reasonable precaution, we cannot represent that the service will restore a piece to factory specification, that no further maintenance will be required, or that the piece will not develop faults unrelated to our work after collection.
The website is provided for informational purposes. Service descriptions and prices are accurate at the time of publication but may be updated. We are not a licensed financial, legal, or insurance adviser; nothing on our website constitutes such advice.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Cogwright's liability to you in connection with any service is limited to the price paid for that service. We are not liable for any indirect, consequential, or special loss, including loss of enjoyment, sentimental value, or anticipated use of the piece.
We take reasonable care of pieces in our custody. In the unlikely event of loss or damage caused by our negligence, our liability is limited to the fair market value of the piece at the time it was received, up to a maximum of RM 20,000 per piece, unless a higher declared value was agreed in writing before service commenced.
Neither party will be liable for delays or failures caused by events beyond their reasonable control (force majeure), including natural disasters, civil unrest, supply chain disruption, or government action.
11. Indemnification
You agree to indemnify and hold Cogwright harmless from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these terms, your misrepresentation of ownership or authority over the piece, or your provision of inaccurate information that led to inappropriate service being performed.
12. Termination
Either party may terminate a service agreement before work commences with no charge. Once work has commenced, termination by you will result in a charge for work completed to that point. Cogwright may terminate and return the piece if conditions in Section 4 are met. Terms relating to payment, liability, and dispute resolution survive termination.
13. Dispute Resolution
These terms are governed by the laws of Malaysia. In the event of a dispute, we encourage you to contact us first at [email protected] so we can attempt to resolve the matter informally. If informal resolution is not reached within 30 days, disputes shall be referred to the courts of Malaysia, with Selangor as the agreed jurisdiction.
Consumers in Malaysia may also refer disputes to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) where the claim falls within its jurisdiction.
14. General Provisions
Entire Agreement: These terms, together with the written service agreement confirmed at drop-off, constitute the entire agreement between you and Cogwright for the relevant service.
Severability: If any provision is found to be unenforceable, the remaining provisions remain in full effect.
Waiver: Failure to enforce any term does not waive our right to enforce it in future.
Assignment: You may not assign your rights under a service agreement without our consent. We may assign our obligations to a successor business while ensuring the terms of the service are honoured.
15. Changes to These Terms
We may update these terms from time to time. The updated version will be posted on this page with a revised date. Services already underway at the time of an update are governed by the terms in effect at the time of service agreement.
